Welcome to Balu Stories.

These Terms of Use and Conditions (“Terms”) govern the use of the Balu Stories application (“App”, “Service”), including all features, content and related services.

By creating an account or logging in, you declare that you have read, understood and fully agree to these Terms.

2. Acceptance of Terms

Acceptance of these Terms occurs implicitly when the user:

• • creates an account, or
• • logins into the App.

If you do not agree to these Terms, do not use the App.

3. Eligibility and parental responsibility

Balu Stories is intended exclusively for people over 18 years of age. Children may not create accounts or use the App independently. Use by children must occur under the direct supervision of a parent or legal guardian.

The legal guardian is fully responsible for:

• • the information provided,
• • the stories generated,
• • reviewing the content before presenting it to the child.

4. Service Description

Balu Stories is an application that uses Artificial Intelligence to create personalized children's stories based on information provided by the user. Stories are generated automatically and may vary in style, content, and quality.

5. Content generated by Artificial Intelligence, responsibilities and limitations

Balu Stories uses Artificial Intelligence (AI) to generate personalized stories based on information provided by the user (“Inputs”). The generated content (“Outputs”) is produced automatically, without prior human review.

5.1 User Responsibility

The user is fully responsible for the Inputs provided to the App and for how they use, share or present the Outputs, especially when intended for children. Before presenting any story to a child, the user must carefully review the content, assessing its suitability for age, sensitivity, family context, and personal values. Stories generated by Balu Stories should not be used as a source of factual information or as a substitute for formal educational guidance, psychological, medical, legal, or professional advice of any nature.

5.2 Artificial Intelligence Limitations

The user acknowledges that AI-generated content:

• • may contain errors, omissions, or inaccuracies;
• • may be incomplete, imprecise, or inconsistent;
• • may, in certain situations, generate inappropriate, sensitive, or unsuitable content for a child, even when child-safe content is requested.

Balu Stories does not guarantee that stories: meet user expectations; are free of flaws; are suitable for all audiences, contexts, or ages.

5.3 Transparency about the use of AI

Stories are generated by machine learning models, which operate probabilistically. This means that:

• • results may vary;
• • answers are non-deterministic;
• • similar content may be generated for different users.

Balu Stories applies security mechanisms, filters, and moderation measures, however, the user acknowledges that no automated system is infallible.

5.4 Misuse, manipulation and exploitation of the system

Balu Stories is not responsible for harmful, inappropriate, or illegal content resulting from:

• • the information provided by the user themselves;
• • the misuse of the Service;
• • attempts to manipulate, exploit, or bypass the AI system, including, but not limited to, prompt injection, jailbreaks, or similar adversarial techniques.

Any attempt at misuse may result in restriction of features, suspension, or termination of the account, as provided in these Terms.

5.5 Emergency situations

The Service is not designed to handle emergency situations. If the user believes that they themselves or a child is at physical, emotional, or psychological risk, they should contact local emergency services or qualified professionals immediately.

5.6 Reporting inappropriate content

If the user identifies content that is inappropriate, illegal, offensive, or potentially unsafe for children, they must communicate with Balu Stories via email: contato@balustories.com. Balu Stories may investigate and take appropriate measures, including: removal of content, limitation of features, suspension or termination of accounts, wherever legally permitted and appropriate. Situations involving risk to child safety receive priority for analysis.

6. Permitted use and restrictions

You agree not to:

• • Use the Service for illegal purposes
• • Provide false or unauthorized information
• • Attempt to bypass, exploit or manipulate the App's systems
• • Use stories for commercial purposes
• • Resell, sub-license or redistribute content
• • Use content for training other AI models
• • Reverse engineer or copy the App

Non-compliance may result in suspension or termination of the account without prior notice.

7. Sharing stories

The App allows downloading stories in PDF format. When sharing a story: The user is solely responsible for the content disclosed; Balu Stories does not control where or how the content will be published; The user must evaluate what personal information they are sharing.

8. User account

Each user may maintain only one account. The user is responsible for maintaining the security of their credentials. Any activity performed by the account is the responsibility of the owner. You can request account deletion as described in the Privacy Policy.

9. Suspension and termination

Balu Stories reserves the right to suspend accounts in case of misuse, terminate accounts that violate these Terms, or remove content considered inappropriate or illegal.

In case of termination due to violation of Terms: There will be no refund of amounts paid; Access to the Service may be interrupted immediately.

10. Subscriptions and payments

The Service offers subscription plans: Monthly, Weekly, Annual. Payments are processed by: App Store (Apple), Stripe. Balu Stories does not control billing, cancellation or refund policies of stores and payment providers.

11. Free trial

Balu Stories may offer a 7 (seven) day free trial. After the trial period, the subscription will be charged automatically. If the user does not wish to continue, they must cancel before the end of the trial. Each user is entitled to only one free trial, unless otherwise indicated.

12. Cancellation

Cancellation of the subscription must be made exclusively through the payment platform used. Cancellation prevents new charges. Access remains active until the end of the period already paid. There is no proportional refund for unused periods.

13. Intellectual property

The App, brand, logo, software and infrastructure are the property of Balu Stories. Generated stories may be used by the user only for personal and non-commercial use. It is forbidden to copy, modify or distribute any part of the App without authorization.

14. Service Availability

The Service is provided “as is” and “as available”. Balu Stories may perform maintenance, update features, or temporarily interrupt the Service. We do not guarantee continuous availability or the absence of flaws.

15. Limitation of liability

To the maximum extent permitted by law: Balu Stories is not responsible for indirect, incidental or consequential damages; Balu Stories' total liability is limited to the amount paid by the user in the last 12 months; If no amount has been paid, liability will be limited to the applicable legal minimum. Nothing in these Terms excludes consumer rights guaranteed by law.

16. Changes to Terms

These Terms may be updated periodically. The latest version will always be available in the App. Continued use of the Service after changes represents acceptance of the new Terms.

17. Applicable law and jurisdiction

These Terms are governed by the laws of the Federative Republic of Brazil. The forum of the consumer's domicile is elected, in accordance with applicable legislation.
